These Terms of Use (“Terms”) govern your access to and use of the websites and online services operated by Dosh Funding (“we,” “us”) at bigdosh.com, doshfund.com, doshfunding.com, and their subdomains (for example www) and related properties we operate on those domains (collectively, the “Site”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.
We may update these Terms at any time by posting a revised version on this page. Continued use after changes constitutes acceptance of the updated Terms, to the extent permitted by law.
Eligibility and business use
The Site is intended for business users and adults. You represent that you have authority to bind any business on whose behalf you submit information.
Not professional advice
Content on the Site is for general information. Nothing on the Site is tax, legal, accounting, or investment advice. Funding offers, rates, and payment programs require separate agreements, underwriting, and approval. Past results do not guarantee future outcomes.
Funding and credit applications
If you submit a funding or pre-approval application through the Site, additional terms apply regarding credit reports, lender referrals, and program disclaimers. Those terms are stated in our Disclosure notice (funding application consent, credit bureau consent, and disclaimer). How information from applications is collected and used is described in our Privacy policy. By proceeding with an application, you agree to review and accept those policies as presented in the application flow.
Permitted use
You agree not to:
- Copy, scrape, mirror, or exploit the Site or its content except as allowed by law or with our prior written consent
- Reverse engineer, probe, or interfere with the Site’s security or availability
- Upload malware, spam, or unlawful, defamatory, or infringing material
- Misrepresent your identity, business, or authority, or harvest data from other users without consent
- Use the Site in violation of applicable law or third-party rights
Intellectual property
The Site, including text, graphics, logos, and layout, is owned by Dosh Funding or our licensors and is protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable license to access and use the Site for your internal business purposes. No other rights are granted.
Third-party links and tools
The Site may link to third-party websites, software, or partner offers. We do not control and are not responsible for third-party content, policies, or practices. Disclaimers
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOSH FUNDING AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SITE SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS OR (B) THE AMOUNTS YOU PAID US SPECIFICALLY FOR THE SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE MONTHS BEFORE THE CLAIM (IF ANY).
Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the fullest extent permitted by law.
Indemnity
You will defend, indemnify, and hold harmless Dosh Funding and its affiliates from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the Site, your violation of these Terms, or your violation of third-party rights.
Termination
We may suspend or terminate access to the Site at any time, with or without notice, for conduct that we believe violates these Terms or harms other users, us, or third parties.
Governing law and disputes
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules, except where preempted by U.S. federal law. You agree to the exclusive jurisdiction and venue of the state and federal courts located in New York County, New York, for disputes arising from these Terms or the Site, subject to mandatory consumer protections in your jurisdiction if applicable.
Severability
If any provision is held invalid, the remaining provisions remain in full force and effect.
